U.S. Department of Health and Human Services (HHS) Recommends Science-Based Thresholds to Target Dangerous Enhanced Kratom Products
Kratom products credit: CDPH DEA takes action based on updated recommendation from HHS October 11, 2026 - WASHINGTON - On Friday, the U.S. Department of Health and Human Services relesed the following: The U.S. Department of Health and Human Services (HHS) provided a new recommendation to the Drug Enforcement Administration (DEA) that establishes science-based thresholds for 7-hydroxymitragynine (7-OH) and mitragynine pseudoindoxyl (MGPI), potent opioid compounds associated with products marketed as kratom. The Department of Justice today announced that DEA issued new Notices of Intent reflecting HHS’ updated scientific analysis and recommendations, including a new Notice of Intent for 7-OH and MGPI incorporating HHS’ recommended concentration and ratio thresholds. Following a review of available scientific data and comments, HHS Assistant Secretary for Health Admiral Brian Christine, M.D., recommended that DEA use concentration or ratio-based thresholds to determine which products containing 7-OH and MGPI are subject to Schedule I control for purposes of temporary scheduling of these substances under the Controlled Substances Act. The recommendation is designed to target concentrated or chemically altered products while distinguishing them from natural botanical kratom products, which may contain trace amounts of 7-OH and MGPI. “We are drawing a clear line between natural kratom and dangerous, enhanced opioid products,” said HHS Secretary Robert F. Kennedy, Jr. “We listened to the public, followed the science, and developed a clear recommended threshold for temporary scheduling that targets concentrated 7-OH and MGPI without sweeping natural botanical kratom into Schedule I. The Trump Administration will continue taking decisive action against dangerous products that fuel addiction while making sure our policies are grounded in rigorous science.” Under the recommendation, 7-OH and MGPI would be controlled in Schedule I for purposes of temporary scheduling when either substance alone, or their combined amount when both are present: Exceeds 1 milligram per gram in solid powders, encapsulated material, or other solid forms, or exceeds 1 milligram per milliliter in liquid preparations; or When the mass of mitragynine present divided by the mass of 7-OH, or MGPI, or the combined amount of 7-OH and MGPI if both present, is less than 100. The ratio-based approach reflects the alkaloid composition of natural kratom products and provides a way to identify products intentionally enhanced or concentrated with 7-OH or MGPI. Available scientific data indicate that 7-OH occurs naturally in botanical kratom at relatively low or trace levels, while some evidence reviewed by FDA suggests MGPI may also occur at trace levels in some natural or kratom-derived products. FDA's scientific review found that 7-OH is substantially more potent than morphine in preclinical studies, with available data indicating approximately two to nine times greater potency depending on the study. FDA also identified evidence supporting a meaningful risk of opioid-like physical dependence and withdrawal from MGPI. “Our recommendation gives DEA a scientifically supportable framework to distinguish natural botanical kratom from products that have been concentrated or manipulated to deliver dangerous levels of potent opioid compounds,” said Assistant Secretary for Health Admiral Brian Christine, M.D. “This approach allows us to focus on the products that pose the greatest threat to public health.” In July 2025, following an FDA scientific and medical evaluation, HHS recommended that 7-OH above a specified threshold be placed in Schedule I of the Controlled Substances Act. In July 2026, DEA announced its intent to temporarily schedule 7-OH above a specified threshold, and HHS simultaneously sought public comment on the proposed threshold. DEA subsequently temporarily placed MGPI and two synthetic 7-OH derivatives, MGM-15 and MGM-16, in Schedule I. Since then, questions have emerged about how scheduling could affect natural botanical kratom products potentially containing trace amounts of MGPI. The new HHS recommendation responds to those concerns by providing DEA with a more precise threshold based on both the concentration of 7-OH and MGPI and their relationship to mitragynine, the predominant alkaloid in kratom. HHS and FDA will continue working with DEA to protect Americans from dangerous concentrated and synthetic opioid products while ensuring federal policy is grounded in the best available science. ProTributeBands.com Clarifies Direct Booking Model for Corporate Event Entertainment Planners
SAN RAMON, CA - September 25, 2026 - PRESSADVANTAGE -ProTributeBands.com, the curated booking and lead generation platform for high-end tribute bands, has outlined how its direct-booking structure works for event planners seeking corporate event entertainment. Under the model, bands featured on the platform negotiate terms and close each booking directly with the client, while ProTributeBands follows up to keep the transaction moving smoothly. The structure separates ProTributeBands.com from traditional booking agencies that insert themselves into every contract. Rather than acting as an intermediary that controls the final agreement, the platform connects event planners, performing arts centers, festivals, wedding clients, and private party hosts with pre-screened, national-act-caliber tribute acts, then steps back so the parties can settle details themselves. The platform maintains contact with both sides to ensure momentum is not lost during the process.Founded by David Victor, former guitarist and co-lead vocalist of the multiplatinum band BOSTON, ProTributeBands.com features tribute acts covering artists such as Queen, The Beatles, ABBA, Journey, The Eagles, and Pink Floyd. Selected bands receive optimized profile pages and booking leads generated through the platform."Event planners often assume a booking platform means another layer of negotiation and markup," said David Victor, Founder of ProTributeBands.com. "The approach here is different. The bands negotiate terms and close each booking directly, which keeps the conversation honest and the details accurate. The platform stays involved by following up so nothing stalls between the first inquiry and the signed agreement."The direct-booking method reflects how corporate and private event planning typically operates. Planners frequently need to confirm technical requirements, stage dimensions, scheduling, and performance specifics with the people who will actually be on stage. By allowing those conversations to happen between the client and the band, the model aims to reduce miscommunication that can occur when information passes through a third party.ProTributeBands.com applies a screening process before an act appears on the platform, focusing on production quality, musicianship, and readiness for larger venues. The company ranks tribute bands across categories including Queen, The Beatles, The Eagles, Journey, Pink Floyd, and BOSTON tributes, drawing on performance quality and audience response. The ProTributeBands guide to hiring a tribute band offers additional context for planners weighing these decisions, covering topics such as understanding the audience and event, assessing entertainment value, viewing an act in person before hiring, and reviewing rider and insurance requirements. The guide addresses the practical considerations planners face when selecting an act for a corporate function, festival, or private celebration."A tribute production for a corporate audience has to hold the room the same way a headline act would," Victor said. "The vetting exists so planners can trust that the act they see listed can deliver at that level, and the direct-booking structure lets them confirm every detail with the band before committing."ProTributeBands.com serves clients across the United States and abroad, working with tribute acts that perform at performing arts centers, summer concert series, product launches, corporate parties, private parties, and wedding receptions. The platform also accepts artist submissions from tribute bands seeking consideration for inclusion. The company operates online at protributebands.com.###For more information about ProTributeBands.com, contact the company here:ProTributeBands.comDavid Victor(925) 236-0217hello@protributebands.com11040 Bollinger Canyon Road Suite E-938, San Ramon, CA 94582

Bar Harbor Parents Again Raise Concerns About How Some Science Education In Sixth Grade.
The Bar Harbor Story is generously sponsored by Restaurant Barn. BAR HARBOR—Parents again raised concerns this week about how Bar Harbor students receive science instruction after fifth grade, months after the same issue came before the Bar Harbor School Board. The concern centers on a past scheduling change at Conners Emerson School that gives fifth graders a full year of science rather than switching between science and social studies at midyear. Principal Dr. Heather Weir Webster told the board that the school has been monitoring test scores, teacher feedback, and the experience of students as it considers whether the current approach is working. If it is not, the approach may be changed, but that would not likely occur this school year. In fifth and sixth grade, the school used to have one semester of social studies and one of science in each year. That schedule shifted because switching at midyear often broke up the learning units. So, approximately two-three years ago, they decided to shift that a bit. Science became a dedicated focus in fifth grade. Social studies was the dedicated focus in sixth grade. The school staff members are hoping to dive deeply into the data and see if the students are having a more quality experience throughout their time in those grades when it comes to science and social studies. If not, things could shift again. This year, Dr. Webster said at the September meeting, potential changes to curricula have been a bit complicated by moving into the school’s new building in late October and early November. “There have been no changes this year because it’s hard enough to handle the move. That allows them to have consistency,” Dr. Webster said. Dr. Webster said that after the Covid pandemic which prevented students from attending school in person, many fifth graders were struggling. “We tried several different configurations,” she said, including a co-teaching model to help with that struggle, but to also see how to best schedule and support those students. “We found that a January switch” where classes switched from social studies to science was really difficult. Part of the decision making stemmed from science being more hands-on and accessible to fifth graders. Social studies was a bit more abstract content, which was why the school tried the current configuration. In a letter submitted as public comment, parent Beth Dumont wrote, “In May 2026, I wrote to express my concern that our middle school students are not receiving consistent instruction in science and social studies. I appreciate that the Board took this concern seriously and requested a presentation from Principal Webster. I am also grateful for the opportunity to meet with Principal Webster and Julie Keblinsky in July to learn more about the current curriculum and scheduling. “During that meeting, I learned that the current model is intended to integrate science and social studies into other subjects during the years or semesters when they are not offered as standalone courses. “While I appreciate the intent behind this model, I remain concerned about its premise. Science and social studies are core academic disciplines that provide students with essential knowledge, skills, and ways of thinking. Yet under the current schedule, students are not guaranteed consistent instructional time in these subjects. Instead, exposure to content in these disciplines may depend on whether opportunities for integration arise within other classes. “To be clear, I strongly support interdisciplinary learning. Integrating science and social studies across the curriculum can enrich students’ educational experiences and help them make meaningful connections across subject areas. My concern is not with integration itself, but with relying on integration as a substitute for dedicated instruction in core disciplines.” Dr. Webster said that they’ve been monitoring test scores, talking to teachers, seeing how the pilot program works. It’s in its third year now of this schedule. One science teacher, she said, told her he’d seen positive outcomes with full year science and that there was a stronger classroom community. Another science teacher had concerns over the readiness last year, but she isn’t feeling that way about this year’s current class. A third teacher for social studies said he loves the full year. A fourth teacher of social studies hasn’t said that anything has changed. For the three fathers who spoke at the school committee meeting, the fractured science curriculum caused concerns. One father said that when he spoke to others, “all were surprised and confused as to why there was no dedicated, continuous science education,” at the school. Though students are testing well in science and math, he worried that without continuity in education, learning is lost. “We shouldn’t have to choose between key learning disciplines,” he said. Matthew Bergin, another father, agreed, adding, “I’m just a little concerned.” In her letter, Dumont wrote, “As the parent of a recent sixth grader who completed an entire year without a dedicated science course, I saw very little evidence that this integration was occurring in a consistent, systematic, or readily identifiable way. This is not a criticism of our middle school teachers, who have been uniformly excellent. Rather, it is a structural criticism of the current schedule.” Dr. Webster gave an update about all aspects of the schedule and how it’s created and she also spoke to social and emotional learning (SEL) in middle school. It’s explicitly taught but also embedded. Science is embedded as well and explicitly taught at all but that one grade. The school schedule is built from lunch out, then electives like art and physical education are placed, before going into the instruction time, teacher planning time, multi-tier support systems (MTSS), and then social and emotional learning. Teachers have to have 250 minutes a week of planning time per their contracts. That’s the minimum and occurs when their students are at specials. “The schedule is really not the purview of the board,” School Board Chair Marie Yarborough reminded the other board members and the public and thanked Dr. Webster for the presentation. The parents were also thanked for coming. Epic v. Health Gorilla: “Working as Designed”
We’ve been on a bit of a legal bender since just before Labor Day, so let’s keep a good thing going! As predicted, Epic does not want its case against Health Gorilla consolidated with the data breach cases, so it filed a motion to vacate the conditional transfer. And because they had to explain to the Panel why this case is different, they put a good chunk of previously unseen Epic v. Health Gorilla discovery record on the public docket! Roll the tape! The Case Against Consolidation Before we get to the fun stuff, let’s do the housekeeping. Epic's motion boils down to three arguments (sorted in ascending order of how well they land): A judge has already decided this. Judge Olguin declined to relate the fraud action to another ELU case (Patterson v. UVA Health), holding that the two do not call for determination of substantially similar questions of law or fact. Epic asks the Panel to treat that (a Rule 42 ruling) as law of the case. The overlap is thin. The three common questions Health Gorilla and the Panel identified are neither numerous nor complex (the qualities the Panel looks for before centralizing). Moreover, they are outnumbered by the questions unique to each side: The breach cases turn on security architecture, notification timing, and patient-level access. The fraud action turns on false treatment attestations and breaches of the framework agreements. Consolidation costs more than it saves. 17 of 21 parties in the fraud action do not appear in a breach case. The cases are also at very different stages: Olguin has a scheduling order running through a January 2028 trial while the breach actions are much more nascent. I like the last two more than the first because they attack the basic economics of an MDL: there just may not be enough shared discovery here to justify dragging all the defendants and a relatively mature fraud case all the way to Florida. On the other hand (while I know exceedingly little about MDL and Rule 42), I have a hard time seeing why a district judge's decision about his own docket would control what the Panel does with the separate § 1407 question. I might be reading between the lines too much, but I sorta think Epic's own brief half-concedes this, framing the two provisions as "two sides of the same coin" but then adding "respectfully submit" (which is often lawyer speak for “we know this is a reach”). The Ladder Gets More Rungs Anyway, the arguments are not why you're here (aside from the lawyers, maybe). Back in June, we discussed how Epic was using the smaller defendants to build an evidentiary ladder toward Health Gorilla and Unit 387. Turns out discovery has been adding a few rungs of its own.

Sunday was the strangest day of this World Cup, in that there was only one match, sandwiched between days with six and three respectively. It would also have been impossible to organise fixtures between any other winners and runners-up while also giving them a reasonable — and relatively similar — number of days since their final group stage fixture.
