Tracy Rietzke Inducted Into Kansas Sports Hall of Fame
Former Kansas Wesleyan standout player and coach Tracy Rietzke ’77 was inducted into the Kansas Sports Hall of Fame Sunday in Kansas City, Kansas. Rietzke was part of a KSHOF record 32-person class inducted into the Hall of Fame in 2026. KSHOF officials divided the inductions into three separate ceremonies concluding on Sunday at Sporting Park. Rietzke retired from coaching volleyball at Rockhurst University following the 2019 season, leading the Hawks for 32 seasons, amassing a 1105-229 record (.828 win percentage). He also coached eight seasons in women’s basketball at Rockhurst from 1988 to 1996, leading the Hawks to a 206-45 record and five NAIA National Championship appearances. Before heading to Kansas City and Rockhurst, Rietzke coached at Kansas Wesleyan after a stellar playing career for the Coyotes. Rietzke coached volleyball, women’s basketball and softball at KWU. In volleyball, Rietzke coached six seasons leading the Coyotes to a 172-56 record. He never won less than 25 games in a season and had three 30-win seasons, the only three in program history, culminating with a 34-9 season in his final year in 1987. He still ranks second in all-time coaching wins at KWU. In women’s basketball, he coached six seasons, leading the Coyotes to a 94-60 record. His career culminated with a 25-5 season in 1987-88, earning the program’s first KCAC Championship that season and the program’s only conference title until 2009. He ranks third all-time in career wins at KWU in the sport. In softball, Rietzke started the dynasty of KWU softball in the 1980’s and 1990’s, leading the program for six seasons, amassing a 126-40 record, ranking third in all-time wins in program history. Rietzke’s teams never finished worse than third place in the KCAC and won or shared four straight conference championships from 1985 through 1988. The Kensington, Kansas native brought his basketball talents to Kansas Wesleyan after two seasons at York College (now University) in York, Nebraska after starring at Kensington High School. In two seasons with the Coyotes, he was a two-time All-KCAC honoree and was an Honorable Mention NAIA All-American in 1976. He continues to hold the KWU school records for season field goal percentage (.771) in 1976, and the career field goal percentage record (.692 (423/611)). His .771 field goal percentage in 1976 led the NAIA. Rietzke is also a member of the Jerry Jones Kansas Wesleyan University Coyote Athletic Hall of Fame (a 1986 charter member), the Missouri Sports Hall of Fame, the American Volleyball Coaches Association Hall of Fame and the Rockhurst University Athletic Hall of Fame. KWU will sponsor Smoky Hills PBS’ presentation of the induction, which will be presented on tape-delay later this fall. Stay tuned to university social media outlets for the announcement of a date and time. Release Courtesy of KWU Athletics

Business Restructuring Review Vol. 25 No. 4 July-August 2026
In This Issue New York Bankruptcy Court: Premature Allegations of Creditor Mistreatment Insufficient to Deny Chapter 15 Recognition of Foreign Restructuring Proceeding In In re ARD Finance, S.A., No. 25-12794 (MG), 2026 WL 817458 (Bankr. S.D.N.Y. Mar. 25, 2026), the U.S. Bankruptcy Court for the Southern District of New York was presented with a petition seeking chapter 15 recognition of Luxembourg's recently enacted bankruptcy law governing judicial reorganization proceedings. The court granted the petition, turning aside challenges to recognition voiced by a creditor group arguing that recognition should be denied based upon allegations of unfairness to creditors in the Luxembourg proceeding that would make recognition manifestly contrary to U.S. public policy. According to the bankruptcy court, recognition was warranted because: (i) the rules and procedures governing the proceeding under Luxembourg law were fundamentally fair; (ii) the petition otherwise satisfied chapter 15's recognition requirements; and (iii) the creditor group's allegations were premature, given the fact that the Luxembourg court presiding over the debtor's restructuring proceeding had not confirmed a restructuring plan, and all creditors had the right to participate fully and voice their objections in the proceeding (including the right to appeal an order approving a plan). Apr. 6, 2026), the U.S. Bankruptcy Court for the Southern District of Florida granted in part and denied in part post-recognition motions filed by an insider of a foreign debtor seeking to bar or limit discovery sought by the debtor's foreign representative concerning allegedly voidable transfers involving the debtors' U.S. real property. According to the court: (i) although chapter 15 includes its own discovery provisions among the relief that may be granted to a foreign representative, the expansive discovery available in cases under other chapters of the Bankruptcy Code is also available in chapter 15 cases; (ii) the discovery sought by the foreign representative was permissible; (iii) discovery regarding matters that were the subject of a pending adversary proceeding had to be undertaken under the more restrictive rules applicable to such proceedings; and (iv) a discovery request would be barred to the extent that it sought production of documents or testimony from a subpoenaed entity that exceeded the geographic limitations specified in such rules. (In re Credito Real S.A.B. de C.V. SOFOM, E.N.R.), 677 B.R. 192 (D. Del. 2026), appeal filed, No. 26-2356 (3d Cir. June 5, 2026), the U.S. District Court for the District of Delaware affirmed a bankruptcy court order granting chapter 15 recognition to a Mexican "concurso mercantile" proceeding and enforcing nonconsensual third-party releases approved by the Mexican court. Agreeing with the bankruptcy court that the releases were not manifestly contrary to U.S. public policy, the district court concluded: "It is well settled that U.S. bankruptcy courts can give effect to foreign orders in recognized foreign proceedings pursuant to the authority granted in Chapter 15, even when those orders contain relief unavailable under U.S. law. [The appellant's] arguments misconstrue the Supreme Court's narrow holding in Purdue, applicable in Chapter 11 cases, as well as the statutory framework of Chapter 15 and its core policy objectives. Accordingly, I will affirm the Enforcement Order." The ruling has been appealed to the U.S. Court of Appeals for the Third Circuit. EP Energy E&P Co., LP (Matter of EP Energy E&P Co., LP), 169 F.4th 609 (5th Cir. 2026), the U.S. Court of Appeals for the Fifth Circuit affirmed lower courts' rulings disallowing a creditor's administrative expense claim. It also rejected the creditor's argument that, because the claims were predicated on state law, a state court should adjudicate the merits of the state law causes of action before the bankruptcy court could allow or disallow the claim as an administrative expense. According to the Fifth Circuit, even though the causes of action were based on state law, the bankruptcy court had jurisdiction to determine whether the creditor's claims should be conferred with administrative expense priority in the debtors' chapter 11 case. Ltd., No. 25-10745 (PB), 2026 WL 592250 (Bankr. S.D.N.Y. Mar. 3. 2026), the U.S. Bankruptcy Court for the Southern District of New York considered the bona fides of an involuntary chapter 11 petition filed by certain holders of U.S. dollar-denominated notes against a holding company for a group of Chinese property development companies that filed a restructuring proceeding in the Cayman Islands after the noteholders filed the involuntary chapter 11 petition. The court denied the debtor's motion to dismiss the chapter 11 case. Given the timing of the filing of the Cayman Islands restructuring proceeding, the absence of any progress in the proceeding for seven months, the debtor's need to restructure notes governed by U.S. law, and the debtor's lack of any meaningful contacts to the Cayman Islands, dismissal of the chapter 11 case was unwarranted under the applicable provision of the Bankruptcy Code, international comity, or the doctrine of forum non conveniens. Union, No. 24-70277-JAD, 2026 WL 560452 (Bankr. W.D. Pa. Feb. 27, 2026), a chapter 7 trustee sought court approval to sell certain avoidance actions to a creditor of the debtor's estate. Potential targets of the subject avoidance actions objected, arguing that such claims were nontransferable powers of the trustee rather than saleable estate property and urging the court to approve their competing settlement with the trustee. The U.S. Bankruptcy Court for the Western District of Pennsylvania disagreed with the potential defendants, holding that they lacked standing to object to the proposed sale, that avoidance actions are indeed estate property, and that the sale—rather than the settlement—best served the estate's interests. Buddy Ayers Construction Inc., No. 25-6, 2026 WL 1686028 (U.S. June 11, 2026), the U.S. Supreme Court overturned a Fifth Circuit decision judicially estopping a chapter 13 debtor from asserting a personal injury claim against a construction company because the debtor failed to disclose the claim during his bankruptcy case. In so ruling, the Court held that "[t]he Fifth Circuit erred by artificially narrowing its inquiry to whether the debtor had knowledge of the underlying facts or a potential motive to conceal the claim." It represents the first time that the Court has applied judicial estoppel in the bankruptcy context, although it has suggested in other contexts that it may be inappropriate where an inconsistent legal position resulted from "inadvertence or mistake." Also in June, the Court denied petitions for certiorari in a few notable bankruptcy cases. The opinion resolves six years of litigation related to Serta's 2020 transaction, where it raised $200 million in new financing and exchanged $1.2 billion of term loans for $875 million in superpriority debt. Judge Lopez found that the debt-for-debt exchange constituted a "payment" under the credit agreement, requiring proportional sharing among lenders, and dismissed various defenses raised by the participating lenders. Science Inquiry Comes Alive for Jacket Middle Schoolers
Snails, sidewalks and Double Stuff Oreos... At Partnership Middle School, instructors are finding innovative ways to help students connect the classroom to what they see in the real world every day. By integrating hands-on experiences and scientific investigations into weekly lessons, 6th and 7th grade science teachers push their classes to explore the curriculum standards through the lens of critical thinking, communication with their peers, experimentation, and scientific inquiry. Last week, two different approaches for two different grade levels saw Jacket teachers ignite the same spark for learning. On Tuesday, 6th graders in Lydia Jones' science class took their lessons outside as they explored the school grounds to identify living and non-living things. Despite the warm temperatures, they engaged in discovering unexpected objects on the campus and connecting that to what they learned in class about the criteria for what qualifies a thing as "living". Ms. Jones tasked students with walking the grounds and listing as many living and non-living things they could find in just a few minutes. Students spotted a fire hydrant, construction vehicles, grass, trees, soccer equipment, rocks, sidewalks, and even a snail hidden in the plants. After they finished the exploration, students returned to the regular classroom to discuss their results and whether their objects were classified correctly. On Thursday, 7th graders in Omini Parks' science class participated in their first lab of the semester as they explored and identified the physical properties of a favorite snack -- Oreos. Ms. Parks identified the class objective before the lab activity began by writing the academic standard on the dry erase board in a declarative statement: "I can collect and evaluate qualitative data to describe substances using physical properties." Students watched a video about how Oreo sandwich cookies are made, and then engaged in a question and answer discussion to give observations on the manufacturing process, review various types of physical properties and their scientific terminology, and talk generally about how the lab inquiry would work. The Q&A ended with a predictable question from students... "Will we be able to eat the Oreos?" The hands-on lab exercise required the 7th grade scientists to observe and record the differences between regular Oreos and the Double Stuff variety based on their physical properties. They followed the instructions in their lab brief to chart a comparison between the two types of cookies by observing properties with their magnifying lenses, measuring the height and diameter of both, and weighing the cookies with and without their filling. The activity let students put their lessons about physical properties into practice with real objects while also practicing vocabulary and writing skills to record their observations and using math skills from the last school year like taking measurements and calculating averages. Of course, they ended the lab by charting the taste of the cookies as well! These types of activities allow students to see the science standards they are learning come to life in the real world and engage with the content in new ways. Beyond that, they serve as a foundation for encouraging and growing scientific inquiry. Later in the school year, students will use the scientific method they are learning to complete science projects that require real research and the ability to explain and answer questions about their process and results. At the school-level competitive Science Fair last year, 41 Partnership students earned a place in the 2026 regional Science Fair held at MSU. From there, 14 advanced to the State Science Fair conducted at Northeast Mississippi Community College in April.

ZeniMax Online Studios leadership to exit as part of Xbox cuts
There are major changes happening atop Maryland-based ZeniMax Online Studios, developer of the Elder Scrolls Online, Game File has learned. Joe Burba, a 14-year veteran of the studio who was appointed to run it last July, is departing, along with ESO executive producer Susan Kath, studio game director Rich Lambert and production director Ala Diaz. Their roles were listed among hundreds of others cut last week from the Maryland offices of ZeniMax, in a WARN letter sent to the state by ZeniMax and obtained today by Game File. Tonight, BUrbam Kath, Lambert and Diaz notified Zenimax Online Studios workers of plans to “transition” to a new leadership team consisting of promoted ZOS veterans. That transition will occur “over the next few months,” they told workers, according to a copy of the notice reviewed by Game File. “We will remain in place during the transition period to help ensure a smooth handoff.” Last week, Microsoft laid off of 1,600 workers across its vast gaming teams in locations around the U.S. and abroad. Just who has been impacted and how hard various studios have been hit has been emerging day by day. Game File reported last week that Microsoft/ZeniMax notified officials in Maryland that 379 gaming jobs were being cut across the state. They tallied cuts in two locations: one for ZeniMax Media Inc. (covering Elder Scrolls/Starfield/Fallout-maker Bethesda Game Studios and central Bethesda game publishing) and one for ZeniMax Online Studios (Elder Scrolls Online). More than 200 jobs were cut at the latter. Last week’s totals did not reveal job titles, nor did Microsoft announce any leadership changes in the ZeniMax group. That has now happened. Earlier today, Game File obtained from Maryland officials a breakdown of the 379 impacted roles, which, extraordinarily, included “studio head.” Microsoft later confirmed to Game File which studio head that referred to: ZeniMax Online Studios’. Microsoft has since has notified studio employees and internally announced new leadership. ZOS will now be run by Josh Henderson, previously head of business operations at the studio, and Nick Giacomini, who was promoted to game director for ESO last August. Subscribe Last week’s news of 200+ cuts at ZeniMax Online Studios generated public sympathy for those workers and questions about the long-term viability of the Elder Scrolls Online. ESO is a massively multiplayer online game that inherently persists on the strength of new content being developed for it. Earlier today, fans and workers in Maryland protested the cuts at the ZeniMax teams in a rally organized by the Communication Workers of America, the union that represents many of the impacted employees. Regarding concerns around the game, a community manager stated on Saturday: “The plan is still to deliver great content, and we will hopefully have an update soon.” In their note to the studio today, the outgoing leaders of ZeniMax Online Studios predicted “growth” for the game: We have tremendous confidence in Josh and Nick, the future of this studio, and the continued growth of ESO. With exciting experiences still ahead for our players as we wrap up work for Update 51 and beyond, we believe that your passion, creativity, and commitment to each other and the community will continue serving as the heartbeat of ESO. The list of jobs cut in the ZeniMax WARN notice in Maryland includes several very senior roles, including: Studio Head Studio Operations Director Studio Game Director Studio Audio Director Studio Art Manager Vice President and Controller VP, Global Sales & Business Development While some of those job descriptions match the exiting ZOS leadership team, Game File couldn’t verify if all were from that studio. The full list of cut roles shared by Maryland officials also covers workers at Bethesda Game Studios and its central publishing office. The following is an excerpt: The list of 379 eliminated ZeniMax jobs in Maryland also includes: four animators three bilingual CS (community service) leads for Chinese, Italian, and Japanese a creative director for the Elder Scrolls Online Player Life Cycle two food service workers seven producers more than 60 senior QA testers. and many others The WARN notice states that almost all of the 379 workers were notified of their layoff on July 6. In fine print, it states: “Approximately 9 employees were notified of the elimination of their position prior to July 6, 2026.” A 2021 mega-merger scaled back Microsoft announced in 2020 that it intended to buy ZeniMax and its network of game studios in 2020, and closed the $7.5 billion deal in March 2021. The purchase, which preceded Microsoft’s acquisition of Activision Blizzard, added several award-winning studios to Microsoft’s portfolio, including Bethesda (Elder Scrolls, Fallout), Arkane (Dishonored), and id Software (Doom). The studios’ output since then included a 2024 Game of the Year contented from MachineGames in the form of Indiana Jones and the Great Circle along with Starfield from Bethesda and the poorly-received Redfall from Arkane Austin. In recent years, a Microsoft repeatedly in cutback mode closed ZeniMax’s Tango Gameworks (which was reconstituted by Krafton) and closed Arkane Austin. The Xbox cuts last week have hit the ZeniMax group hard, with 158 jobs eliminated in Texas, many of them at id, and 379 from the ZeniMax teams in Maryland. Xbox also said last week that it would be entering a consultation process around Arkane Lyon, a process expected to end in a sale, shutdown or other form of divestment. The Lyon team has been working on a game tied to Marvel’s Blade vampire-hunting super-hero.
